Welcome to www.megadispatch.com.ng, a proprietary website/software of Mega Dispatch Company.("Mega dispatch", "we", "us"). We are a platform connecting dispatch riders with individuals and buisnesses who need delivery services. By using this platform, you agree to be legally bond by this terms and conditions. If you do not understand any of this agreement, please contact us at info@megadispatch.com.ng. We would be happy to guide you through.
1. Definitions:
"Rider" refers to any individuals who uses the Mega Dispatch platform to offer delivery services.
"Customer" refers to any individual or buisness who uses th Mega Dispatch plaftform to request delivery services.
"Delivery" rerfers to the transportation of goods from a pickup location to a delivery location as requested by a customer.
"Platform" refers to the Mega Dispatch website, software or mobile application, and all related infrastructure.
2. General Terms
2.1. These terms of use governs the use of website application and software (collectively called the "platform") and defines the legally binding terms on which you access, browse, register or otherwise use the platform to enjoy our services. The terms of use apply to all users of the platform including guest users.
2.2. By using our platform in any manners you accept these terms of use and agree to comply with and be bound by them.
2.3. You understand that breach of any of these terms of use may result in your right to use the services on the platform being suspended, restricted or withdrawn.
3.4. We may amend these terms of use at any time by amending these page. Please ensure you check this page from time to time to take notice of any changes we make as they will be binding on you. If you are an existing user, we will.
4.5. If you do not agree to our terms of use, you must not access this platform or use the services.
4.6. Riders must be pemitted to confirm Order ID from customers, same goes to customers before releasing any item to the Rider.
4.7. We only cover Lagos state, we don not go beyond the lagos state terriotory.
4.8. Any order that fills the riders box, attracts an extra charges of #2000, and we do not accept orders bigger than riders box.
3. Membership and Registration
3.1. Our services are available for individuals who are 18 years and older and who can form legally binding contract under applicable law. You represent that you are at least 18 years old and that all registration information you submit is accurate and truthful.
3.2. User who fulfill the requirments above must create an account in accordance with section 3.3 below.
3.3. In order to create an account on our platform, you must provide full name, email, default pickup address, phone number. A one time password would be provided upon signing up. It is at that point you would be required to tick a box to confirm your agreement with our terms of use and privacy policy.
3.4. You are solely responsible for keeping your login details confidential and must not disclose or share it with anyone. You would be responsible for all activities and orders that takes place using your login information. In any event of loss of theft, loss or unauthorised use of a user password or account, you must contact us immediately at support@megadispatch.com.ng.
3.5. Customers must provide accurate and complete information about thier deliveries, including pickup and delivery locations, package details, and any special instructions
3.6. Customers are responsible for ensuring that thier packages are well labelled and packaged for safe transportation.
3.7. Customers are responsible for paying all applicable fees for delivery.
3.8. Customers must treat staffs and Riders with respect and courtesy without insulting any of them.
3.9. Customer should notice that riders do not go beyond the gate for delivery non do they climb staircase, downfloor is thier limits.
3.10. As a user, you represent and understand that all information provided is accurate, up to date, honest and not misleading, commit to uploading your account informations as and when it changes, and accept sole respomsibility for any direct or indirect adverse consequences caused by the inaccuracy of this information or failure to update this information.
3.11. The information submitted to create or update an account constitutes a proof of your identity. We reserve the right to verify, at anytime the accuracy of the information provided and to ask you for any additional documentation for the purpose of identity verification.
3.12. You can decide at anytime to terminate your account, in which case your details will be deleted from the platform
3.13. Riders are responsible in confirming every item before picking them up.
4. Payment
4.1. All payments made on the platform are processed by a third-party payment processor which provides a gateway for online payments.
4.2. In order for users to successfully make a booking, payment for booking can be made in two ways:
Through a closed loop electronic wallet features on the platform which you top up via the available payment channels. You can only use the units or value alloted to you on the wallet through our platform, or you make payments through a debit card, or through bank transfer, or any other payment methods/channel our payment service partners may provide from time to time.
4.3. The payment processor is solely responsible for all payment transactions consummated on our platform.
4.4. In order for your booking to be succesful, payment must be succesful.
4.5. By creating an account, you agree to be bounded by these terms of payment.
5. Refund Policy
6. Limitation of Liability
6.1. Nothing in these terms of use excludes or limits our liability for personal injury arising from your negligence or fraudulent nisrepresentation or any other liability that cannot be excluded or limited by Nigeria law.
6.2. To the extent permitted by law, we exclude all conditions, warranties, representatios or other terms which may otherwise apply to our platformor any content on it, whether express or implied.
6.3. We assume no responsibility for the content of websites linked to our platform. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liablefor any loss or damage that may arise from your use of them.
6.4. As a user, please note that we only provide our platform for domestic and private use. You agree not to use our platform for any commercial or buisness purposes without a written unequivocal consent and we have no liability to you for any loss of profit or loss buisness opportunity.
6.5. To extent permitted by the law, Mega Dispatch shall not be liable to you for any indirect punitive, incidental, special or exemplary damages arising out of your inability to use our Services.
6.6. We are not liable for any damage which may be incurred by you from unathorized use of, tampering or access to your Mega Dispatch account.
6.7. Mega Dispatch is not liable and you agree not to hold Mega Dispatch liable for any damages or losses resulting either directly or indirectly from:
delays or disruptions in our services, software, and platform, your use or inability to use or access services or Platform, a suspension or other actions taken with Mega Dispatch account, any access or use of our services in manner that is inconsistent with this terms of use or any error, inaccuracies, losses or omission in or to any data provided to us, and any damage caused by a virus or other technologically harmful material that may infect your electonic devices due to the use of our platform or any website linked to it.
6.8. We will not be liable to any user loss or damage, whether in contract, tort (including negligence), breach of statutory duty, otherwise, even if forseeable arising in connection with use of or inability to use our platform.
7. Insurance
THE COMPANY SHALL ENSURE THAT THE COURIER AND LOGISTICS SERVICE PROVIDERS OBTAIN AND KEEP A COMPREHENSIVE MOTOR VEHICLE INSURANCE, PERSONAL ACCIDENT COVER AND/OR CARRIER’S LIABILITY COVER, AS APPLICABLE. THE CARRIER’S LIABILITY COVER SHALL PROVIDE INSURANCE COVERAGE AGAINST LOSS OR DAMAGE FOR PACKAGES DELIVERED THROUGH THE KWIK PLATFORM.
YOU SHALL ONLY BE ENTITLED TO COMPENSATION FROM THE INSURANCE PROVIDER UNDER THE THIRD PARTY SERVICE PROVIDER’S LIABILITY COVERAGE PROVIDED BY THE COMPANY IN THE EVENT OF LOSS OR DAMAGE TO A PACKAGE.
You further warrant that I shall not use the Service to transport the following categories of items:
- Items of high, unusual and/or unpredictable value such as gold or diamonds
- Any item whose trade is forbidden by international treaties, such as Ivory
- Ammunitions
- Bank bills
- Explosives/Fireworks
- Weapons
- Ammunitions
- Biological substances presenting a biohazard
- Illegal drugs & Narcotics
- Live animals
- Hazardous waste
8, Indemnification
8.1. You agree to indemnify, defend and hold Mega Dispatch harmless against any loss, damage, liability and claim due to or arising out of our Services, and breach of theseterms use or any applicable law.
8.2. We reserve the right at your expense to assure the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims
9. Governing Law
These terms and conditions are governed by the Nigerian law. In event of a dispute regarding the validity, interpretation and /or execution of these terms the parties submit to the exclusive jurisdiction of the Nigerian courts.
10. Personal Data
The company collects and processes users personal data. For further detais, every user is encouraged to read the platform "privacy policy". For the avoidance of doubt, with the exception of our payment provider, we do not share your details with any other third paties.
11. Complaints
User are to submit compliants to the customer service via chat box on the website or plaform.
12. Pickup and Delivery Services
Using the Pick Up and Drop Off service you can send packages from a particular location to another location within the Territory. The Pick Up and Drop Off Services are provided to you directly by Mega Dispatch and all information required to provide this service which will include personal data shall be provided by you via the Mega Dispatch platform. You will be required to choose your preferred delivery option at the point of your Order; you may select either Express Delivery, Same Day Delivery, Roundtrip Delivery or Bulk Delivery. When you select either option, Mega Dispatch will assign a rider to you for the provision of the service at the designated locations provided by you. If you select Immediate Delivery, the assigned Rider shall pick up your Goods and deliver to your location as communicated via the Platform. This option implies that the assigned Rider will not pick up any other Orders until the assigned Rider has delivered your Order to your location. See cost on your platform for the pricing. Where you select Same Day Delivery, the assigned Rider is permitted by you and Mega Dispatch to pickup your Order and deliver to the location communicated on the same day as the pickup day. The assigned Rider will be permitted to pick up other Orders prior to delivery of your Order. You agree and acknowledge that the details provided (including personal identifiable information as well as locations have been voluntarily provided by you on the Mega Dispatch Platform and such information will be used for the Mega Dispatch Services in accordance with the Privacy Policy. Any requests for a Pick Up and Drop Off of Restricted Goods or prohibited Goods by any statute or law or regulation shall not be fulfilled and may lead to cancellation of Accounts. You agree that before requesting a Pick-up and Drop-off Service, you have actual knowledge of the contents of the package sent or requested by you through Mega Dispatch platform, and that such contents are legal and within limits of transportation under any applicable laws. Such contents shall not be restricted and/or banned and/or dangerous and/or prohibited for carriage (such items include, but are not limited to, radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates, gold and silver ore, bullion, precious metals and stones, jewelry, semi-precious stones including commercial carbons or industrial diamonds, currency (paper or coin)of any nationality, securities (including stocks and bonds, share certificates and blank signed share transfer forms), coupons, stamps, negotiable instruments in bearer form, cashier's cheques, travellers’ cheques, money orders, passports, credit/debit/ATM cards, antiques, works of art, lottery tickets and gambling devices, livestock, fish, insects, animals, plants and plant material, human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens, hazardous or bio-medical waste, wet ice, pornographic materials, contraband, bottled alcoholic beverages or any intoxicant or narcotics and psychotropic substances or any other prohibited material or material for the transportation of which specific authorization/license is required under applicable laws).
13. Promotions
Mega Dispatch, in its sole discretion, may make promotions available to any User or potential User. These promotions, unless made to you, shall have no bearing whatsoever on your Agreement or relationship with Mega Dispatch. Promotions will in many cases be made available to you via alpha numeric codes (“Promo Codes”). Mega Dispatch reserves the right to withhold or deduct credits or benefits obtained through a promotion in the event that Mega Dispatch determines or believes that the redemption of the promotion or receipt of the credit or benefit was in error, fraudulent, illegal, or in violation of the applicable promotion terms or this Agreement.
14. Walllet
This is to inform you that any money on your wallet can't be withdraw, sold, exchanged or transfeered at anytime. It can only be used for placing bookings on the platform. And any cancellation of orders or refund would be made directly into your wallet account.
15. Assignment
THE COMPANY MAKES NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE OR SOFTWARE. THE COMPANY DOES NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE OR SOFTWARE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR‐FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA, (B) THE SERVICE OR SOFTWARE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (C) ANY STORED DATA WILL BE ACCURATE OR RELIABLE, (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (E) ERRORS OR DEFECTS IN THE SERVICE OR SOFTWARE WILL BE CORRECTED, OR (F) THE SERVICE OR THE SERVER(S) THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SERVICE AND SOFTWARE IS PROVIDED TO YOU STRICTLY ON AN “AS IS” BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‐INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY THE COMPANY. THE COMPANY MAKES NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, SAFETY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF ANY SERVICES, PRODUCTS OR GOODS OBTAINED BY THIRD PARTIES THROUGH THE USE OF THE SERVICE OR SOFTWARE. YOU ACKNOWLEDGE AND AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SOFTWARE AND SERVICE, AND ANY THIRD-PARTY SERVICES OR PRODUCTS REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16. Terms and Termination
This terms of us becomes effective from date you start usingour services and continues until it is terminated by either you (through the closing of your account) or us.
